Conditions of Sale for Urban Plot

 

1. Introduction

​

These Conditions of Sale shall govern the sale and purchase of products from Urban Plot ("Urban Plot" or "we" or "us"). By placing an order, you agree to be bound by these Conditions.

2. Orders

​

  • All orders are subject to acceptance by Urban Plot. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing information, or credit card authorisation issues.  

  • If you place an order for a digital garden design plan, you will be required to complete a questionnaire. Once we have received your completed questionnaire, we will begin work on your design plan.

  • We will endeavor to deliver your digital garden design plan within 7 days of receiving your completed questionnaire. However, we cannot guarantee delivery times, and we will not be liable for any delay in delivery.

  • If you place an order for a physical product, we will acknowledge your order by sending you an email confirmation. This confirmation does not constitute acceptance of your order. Acceptance will occur when we ship the product to you.

  • We reserve the right to limit the quantity of items purchased per customer or per order.

 

3. Pricing

​

  • All prices are quoted in British Pound Sterling (GBP). Prices are inclusive of VAT where applicable.

  • We reserve the right to change prices without notice. Prices displayed on the website at the time of purchase will be the applicable prices.

 

4. Payment

​

  • Payment must be made in full at the time of purchase using a valid credit or debit card.

  • We reserve the right to verify your credit or debit card information before processing your order.

 

5. Delivery

​

  • Digital Products: Digital garden design plans will be delivered via email to the email address provided by you at checkout.

  • Physical Products (Plants): We will endeavor to deliver your plant order within the estimated delivery time specified on the product page. However, we cannot guarantee delivery times, and we will not be liable for any delay in delivery.

  • Delivery charges for plants will be calculated based on the number of plants ordered and your delivery location. Delivery charges will be added to your order total at checkout.

  • You are responsible for ensuring that the delivery address provided at checkout is accurate and complete. If the delivery address is incorrect, we will not be responsible for any additional delivery charges or delays.

  • We will take reasonable care to ensure that the plants are healthy and in good condition when shipped. However, we cannot guarantee that the plants will survive the journey to your home. If the plants arrive damaged or unhealthy, please notify us within 24 hours of receipt.

6. Returns

​

  • Digital Products: Due to the nature of digital products, we do not offer refunds for digital garden design plans once they have been delivered.

  • Physical Products (Plants): You may return any unwanted or faulty plants within 14 days of receipt. Returned plants must be in their original condition, with all tags and packaging intact.

  • To return a plant, please contact us to obtain a return authorization number. You must return the plant to us at your own expense, using a trackable method of shipping.

  • We will refund the purchase price of the returned plant, excluding the original delivery charges, once we have inspected the plant and confirmed that it is in good condition.

  • If the plant is found to be faulty, we will refund the purchase price, including the original delivery charges.

  • Please note that we do not accept returns for plants that have been used or damaged by the customer.

 

7. Limitation of Liability

  • Our liability in contract, tort (including negligence), statutory duty or otherwise in connection with the supply of any products or services will be limited as follows:

    • We shall not be liable for any loss of profits, loss of business, loss of contracts, loss of anticipated savings or any indirect or consequential loss.

    • Our total liability in respect of all claims arising under or in connection with these Conditions shall not exceed the total price of the products or services supplied.

 

8. Governing Law

​

  • These Conditions shall be governed by and construed in accordance with the laws of England and Wales.

  • Any dispute arising under or in connection with these Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
